New Administrative Penalty Framework for Labour, Social Insurance and Employment Compliance in Vietnam

On 15 July 2026, the Government has issued Decree No. 283/2026/ND-CP (“Decree 283”), replacing Decree No. 12/2022/ND-CP and introducing a significantly strengthened administrative penalty regime across labour, social insurance, unemployment insurance, foreign employee management, occupational health and safety (“OHS”), trade union obligations and overseas employment matters.

The Decree will take effect from 10 September 2026 and reflects the authorities’ increasing focus on labour law, payroll and social security compliance, with substantially higher financial exposure for employers that fail to comply with statutory requirements.
